By accessing or using enderturing.com or the Ender Turing platform ("the Service"), you agree to be bound by these Terms of Use ("Terms").
If you're agreeing on behalf of a company, you represent that you have the authority to bind that company. If you don't agree to any part of these Terms, you must not use the Service.
For paying customers, the master subscription agreement (MSA) and order form take precedence over these Terms where they conflict.
Ender Turing provides AI-powered conversation-intelligence software for contact centers — speech analytics, behavior analytics, automated quality management, agent management, and the AI QA Specialist (Ender). The Service is delivered as SaaS, with on-premise deployment available on Enterprise plans.
Free resources on our website (blog, case studies, webinars, FAQ) are available without an account. Paid features require a subscription.

Prices are in USD unless otherwise specified. Taxes (VAT, sales tax) are added where required by law.
The Service — software, design, content, trademarks — is owned by Ender Turing and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service per these Terms.
You retain ownership of your data — conversations, transcripts, scorecards, configurations. We use your data only to operate the Service, improve our models for your tenant, and meet legal obligations. We do not train shared models on your conversation content without explicit written consent.
Feedback you give us about the product is non-confidential and may be used to improve the Service without obligation.
You agree not to:
The Service is provided "as is" and "as available". We make commercially reasonable efforts to keep it operational, accurate, and secure — but we don't warrant that it will be uninterrupted, error-free, or that AI-generated outputs will be perfect.
The Service is not a substitute for legal, financial, medical, or professional advice. You're responsible for validating outputs that affect material decisions.
To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — even if we've been advised of the possibility.
Some jurisdictions don't allow these limitations. In those cases, our liability is limited to the maximum extent permitted by local law.
You agree to indemnify and hold Ender Turing harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service in violation of these Terms or applicable law, or from content you upload to the Service.
You can cancel your account at any time through the in-product settings or by emailing billing@enderturing.com.
We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a security risk — with notice where possible.
Upon termination, you can export your data within 30 days. After 30 days, we permanently delete data unless legally obligated to retain it.
These Terms are governed by the laws of Lithuania (without regard to conflict-of-laws principles). Any dispute will be resolved in the courts of Vilnius, Lithuania.
For Enterprise customers, the master subscription agreement may specify a different governing law and dispute-resolution mechanism (e.g., arbitration).
We may update these Terms from time to time. For material changes, we'll notify customers via email or in-product notification at least 30 days before the change takes effect.
Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you don't agree, your remedy is to stop using the Service.
